Greenwashing claims in compostable packaging can put distributors in a very difficult position.

 

And the risk goes beyond reputation. Retailers and distributors are being held directly liable for the environmental claims their suppliers put on packaging, even when those claims originate upstream.

 

California district attorney coalitions have already extracted $1 million from Walmart, $1.5 million from Amazon, and $500,000 from Costco for selling products with third-party-supplied “biodegradable” or “compostable” labels.

 

The FTC’s civil penalty for a single substantiation violation reached $53,088 in 2025.

 

The good news is that if you build the right vetting framework, you can protect yourself. This guide walks you through exactly what that looks like.

 

 

What Counts as Greenwashing in Compostable Packaging

 

The Federal Trade Commission’s Green Guides (16 CFR Part 260) are the federal benchmark for environmental marketing claims.

 

They don’t carry the weight of a regulation, but the FTC enforces deceptive practices under Section 5 of the FTC Act in line with them.

 

Under Section 260.7, a “compostable” claim is only valid if:

 

  • There is competent and reliable scientific evidence that the entire product breaks down into usable compost in roughly the same timeframe as the surrounding compost feedstock.
  • The claim is qualified to disclose whether the product requires an industrial composting facility, especially when such facilities are unavailable to most consumers in the area.

That second point matters more than most distributors realize.

 

A 2025 study by the Sustainable Packaging Coalition found that only 18.1% of the researched U.S. population has access to programs that accept food waste and compostable packaging.

 

Slapping “100% compostable” on a straw without that disclosure is, by the FTC’s standard, misleading.

 

“Biodegradable” is even more restricted. The FTC’s 1-year rule under Section 260.8 requires that an unqualified biodegradable claim be backed by evidence that the entire item will completely decompose within 1 year of customary disposal.

 

Since landfills almost never achieve that, any unqualified “biodegradable” label on plastic packaging is presumptively deceptive. California goes further and flat-out bans the term on plastic products.

 

California’s AB 1201 requires compostable packaging to be certified to ASTM D6400 or D6868 by an approved third party. There is also a USDA National Organic Program allowable-input requirement. That kicks in by June 30, 2027.

Greenwashing Tactics You Need to Recognize

 

Suppliers rarely make claims that are outright false. The more common pattern is a claim that is technically defensible in one narrow context but misleading in the way it is presented.

 

Here are the most common ones to watch for.

 

  • Vague general claims: Words like “eco-friendly,” “sustainable,” “green,” or “earth-friendly” are red flags under the FTC Green Guides (Section 260.4), which states that broad environmental claims are virtually impossible to substantiate. The EU has already banned them outright.
  • Unqualified “biodegradable” labels: As covered above, this is the highest-risk claim for distributors. The ECM BioFilms case is the landmark precedent. The FTC held that suppliers who provide “Certificates of Biodegradability” to their downstream distributors are liable for giving those distributors the means to deceive customers.
  • Home compostable claims without the right certification: Most compostable packaging is only certified for industrial composting at temperatures of 55-60°C and above. Claiming home compostability requires a TÜV Austria OK Compost HOME certification, or BPI’s Commercial and Home Compostable tier (launched December 1, 2025). Anything else is an overreach.
  • Fake or expired certification seals: Some suppliers use logos that closely resemble BPI, OK Compost, or the Seedling mark, but carry no issuer name or certificate number. Others use seals that expired years ago. The FTC (Section 260.6) states that a seal not conveying the specific attribute being certified implies general environmental benefit, which is deceptive.
  • Hidden trade-offs: A product can be genuinely compostable and still contain PFAS (per- and polyfluoroalkyl substances) used as a grease barrier. PFAS contaminate compost streams and are now banned in food packaging across California, Washington, New York, Maine, and several other states. A “100% compostable” label means nothing if the product fails a total fluorine test.
  • Misleading PFAS-free claims: Saying a product is “PFAS-free” without lab documentation is its own category of risk. A proper PFAS-free claim requires total organic fluorine testing from an ISO/IEC 17025-accredited lab, with results below 100 ppm (the California and Compost Manufacturing Alliance threshold) or below 20 ppm for stricter certifications like Intertek’s PFAS-Free standard.

Knowing how to explain PFAS-free certification to your customers is becoming a baseline expectation for distributors in those markets.

How to Vet Suppliers Before Adding Products to Your Line

 

Before you onboard any supplier making compostable or eco-claims, build a documentation packet for every SKU.

 

Here is what to request.

 

Certification documentation:

 

  • Ask for the certificate number, the name of the issuing body, the expiration date, and the exact SKUs the certificate covers.
  • Make sure the certification is for the finished product you are buying. A certified resin does not mean the final product is certified.

Lab test reports:

 

  • Ask for the full ASTM D6400, D6868, or D8410 test report from an accredited lab. This tells you how fast the product breaks down. It also shows disintegration results, heavy-metal levels, and plant-toxicity results.
  • Ask for a PFAS test showing total organic fluorine below 100 ppm. This confirms the product has no harmful fluorinated chemicals in it.

Food safety documentation:

 

  • Ask for FDA food-contact compliance documents under 21 CFR 170-199. This confirms the product is safe to use with food in the U.S. market.
  • Ask for safety data sheets for any inks, adhesives, and coatings used on the product.

After collecting documents, verify them independently. Do not rely on a supplier-supplied PDF.

 

  • BPI: Search the official BPI Online Product Catalog at bpiworld.org. More than 50,000 individual SKUs are listed. Match by company name and item number, and confirm whether the certificate covers the new Commercial and Home Compostable tier if home composting is being claimed.
  • TÜV Austria: Verify OK Compost INDUSTRIAL or OK Compost HOME status at okcert.tuvaustria.com.
  • USDA BioPreferred: Check at biopreferred.gov/BioPreferred/. Remember that this certification covers biobased content only. It says nothing about compostability or end-of-life.

A legitimate lab report will carry an accredited lab letterhead, an ISO/IEC 17025 accreditation number, a unique report number, sample identification details, and a signed analyst name.

 

A supplier-generated “compliance statement” or “self-declaration” is a starting point at best.

 

Once you have verified a supplier’s certifications, it is also worth understanding how their products behave during shipping and storage.

A few things worth noting. BPI changed its scope in December 2025 to include a Commercial and Home Compostable tier. Any assumption that “BPI certified” means industrial-only is now outdated. Always check which tier the certificate covers.

 

USDA BioPreferred is commonly misrepresented. It confirms that a product contains renewable, plant-derived carbon. It says nothing about whether the product will break down in a compost facility or anywhere else.

 

 

Marketing Claims That Should Raise a Red Flag

 

Greenwashing often hides in plain sight. Before you add any product to your line, run through this list of terms on the packaging, spec sheets, and e-commerce listings. Any one of these without supporting documentation is a red flag.

 

  • “Biodegradable” with no conditions stated: If you see this on plastic packaging with no timeframe or composting environment listed, do not stock it. California bans this claim outright, the FTC flags it as deceptive under Section 260.8, and the EU is banning it in September 2026.
  • “Home compostable” with no certificate number: You should see a TÜV Austria OK Compost HOME or BPI Commercial and Home Compostable certificate number. If you do not, the claim has no backing.
  • “Ocean-safe,” “ocean-friendly,” or “ocean-degradable”: No accepted standard exists for these claims. The FTC treats them the same way it treats other unsubstantiated biodegradability claims.
  • “Carbon neutral” or “net zero” on a product: Ask for a third-party verified life cycle assessment based on ISO 14067. Without that, you have no way to confirm the claim.
  • “PFAS-free” with no lab data: Ask your supplier for a total organic fluorine test result. A claim without documentation is not something you can rely on.
  • “BPI Certified” with no certificate number: This could mean the resin is certified, not the finished product you are actually buying. Always check the BPI Product Catalog to confirm.

Any of these should trigger a documentation request before the product goes into your line.

  1. Stop sales: Pull the flagged product from your active listings while you look into it.
  2. Gather your paperwork: Find the certification, lab test reports, and any written warranty your supplier gave you for that product.
  3. Contact your supplier: Email them and ask for a written response plus fresh test data. Give them 5 business days.
  4. Review your own materials: Go through your website and marketing materials. Check if you are repeating the same claim being questioned.
  5. Get legal counsel involved: If the complaint mentions the FTC, a state attorney general, or a class-action firm, contact your legal counsel right away. These are signals that things could get serious fast.

From day 2 through day 10, here is what you should focus on.

 

Compare the on-package claim against the FTC Green Guides and any applicable state law. Audit your e-commerce listings, marketing materials, and sales-team training decks for the same language.

 

If a gap exists between the claim and the substantiation, put together a corrective action plan, such as label revision, sell-through plan, customer notification, and a supplier remediation request.

 

When communicating with customers, be specific. Saying “this product is BPI Certified Compostable to ASTM D6400 for use in industrial composting facilities, certificate number XYZ expiring [date]” is more credible and more defensible than a general assurance.
